What is Fiduciary Investment Management and Advice?

This is from the SEC Website (sec.gov): Information for Newly Registered Investment Advisers 11/12/2010: “As an investment adviser, you are a “fiduciary” to your advisory clients. This means that you have a fundamental obligation to act in the best interests of your clients and to provide investment advice in your clients’ best interests.  You owe your clients a duty of undivided loyalty and utmost good faith. You should not engage in any activity in conflict with the interest of any client, and you should take steps reasonably necessary to fulfill your obligations.  You must employ reasonable care to avoid misleading clients and you must provide full and fair disclosure of all material facts to your clients and prospective clients.” It goes on. 

 

Starting in 2020, other financial professionals will have to act in a client’s best interest. However, it’s clear from the SEC’s comment that an Investment Adviser is held to standards going beyond just best interest when engaged to manage investments and provide financial advice. 

Investment Management

LayLine employs an institutional, discretionary, investment management style. Decisions

are guided by the stated target allocation and investment objectives, within any restrictions

the client has indicated in the IMA (investment management agreement), and always in the

client’s best interest.

Discretionary Trades:  LayLine does not sell investments or get paid to make trades. When investment analysis indicates that it is prudent to make a change in positions or allocations, with discretion, the change in all accounts where it is appropriate.  Neither

the firm nor Investment Adviser gets paid to trade; there is no interest other than the

clients to place a trade.  Trade discretion allows an Adviser to buy and sell without first

contacting clients.  This allows all trades to be entered at the same time, whether they

be held in small or large accounts.

 

Charles Schwab & Co:  As LayLine's exclusive custodian, Schwab provides expedited

trade execution, efficient investment management, and comprehensive account maintenance needed in today’s complex markets.  Investment clients get low trading costs, advanced

custodial services and account maintenance, account statements, trade confirms, great

internet portal, direct access to accounts, and more.

LayLine Investment Strategy

LayLine combines capital market style fundamental analysis, InterMarket macro analysis,

and a technically driven relative strength (RS) discipline in our investment strategies.  This

allows for both income and growth asset classes to be efficiently and effectively managed

together in the same portfolio.  

 

LayLine's investment strategies are unencumbered in the techniques that can be deployed at any given time. They may include: short term capital gains capture, sector rotation and 

allocations, fundamental situations, economic positioning, paired and contingent trades,

and style positioning.  Not being tethered to a particular approach allows us to be

tactical, maneuvering in the shorter term to accomplish the longer term goal, and

strategic, operating with a much longer view, in our investment allocations.

Advisory

Investment Selection and Management

In our fiduciary capacity, we work with clients to help establish investment objectives, discuss types of investments, determine type of investment account(s) most appropriate, fees and

costs associated with investing, review any conflicts in recommendations, identify restrictions

or other investment considerations clients have and more.  We manage and monitor client’s investment accounts according to an IMA (Investment Management Agreement).

 

CR (Consolidated Report)  

In addition to monthly account statements provided by Schwab, a CR is sent out quarterly 

that combines a client's accounts into a single portfolio. The CR provides analysis of 

all positions held in accounts managed as one portfolio for a comprehensive evaluation

of investments held by client, a review of management fees, compete list of individual 

securities held at Schwab, and an investment simulator for projections. 

 

Financial Advisory

LayLine provides advice on a broad variety of financial topics either by email, on the phone,

or in person.  Advice requested by clients has included: Refinancing the house, buying a car, funding a 401k, paying for a trip(s), donating to the church, helping the kids out, advice

with 401k allocations among other topics.  As a fiduciary, we are required to review any

potential conflicts of interest in the advice given.

 

Financial Planning

LayLine provides a wide variety of financial planning services, from cash flow analysis to full blown long-term financial plans.  As a fiduciary, we must act with a duty of loyalty and

reasonable care that other financial professionals may not be bound by.
